Criminal: Summary Pre-Trial Procedure

Step One: The defendant is charged and summonsed to court for minor offences. 

Step Two: The first hearing will be in Magistrates. They will make a decision whether to give the defendant bail or whether he is to be remanded in custody. They will decide if the defendant should get public, legal funding to help pay for legal representation. 

Step Three: If the defendant pleads guilty then Magistrates will sentence a maximum of 6 months imprisonment or a £5000 fine. They can transfer to Crown Court if they feel they do not have enough sentencing powers. 

Step Four: If the defendant pleads not guilty then a trial will take place in Magistrates court. 

Step Five: If the defendant is found guilty, Magistrates can sentence or they can transfer to Crown Court for sentencing if they feel their sentencing powers are not enough.
